Comments Re: Proposed Changes to the Mining Act

Executive Summary In modernizing the Mining Act, Ontario has the opportunity to strengthen environmental protection to ensure the long-term health, safety and prosperity of the province. In order to do so effectively, a modernized Mining Act must:

  • Ensure all mining projects are subject to the provincial Environmental Assessment Act

  • Prohibit mining claims on ecologically sensitive lands;

  • Provide for enhanced and substantive consultation with surface rights holders, including aboriginal people;

  • Ensure the Act applies to uranium mining; and

  • Modernize associated regulations, including the proposed "Good Samaritan" Regulation.
