Comments Re: Proposed Changes to the Mining Act
Please find enclosed Lake Ontario Waterkeeper's comments on the above-mentioned matter.
Executive Summary In modernizing the Mining Act, Ontario has the opportunity to strengthen environmental protection to ensure the long-term health, safety and prosperity of the province. In order to do so effectively, a modernized Mining Act must:
Ensure all mining projects are subject to the provincial Environmental Assessment Act
Prohibit mining claims on ecologically sensitive lands;
Provide for enhanced and substantive consultation with surface rights holders, including aboriginal people;
Ensure the Act applies to uranium mining; and
Modernize associated regulations, including the proposed "Good Samaritan" Regulation.
