Enbridge submits final Line9B arguments in writing

On Friday afternoon, Enbridge submitted its final written reply arguments to the Board. Below you'll find a summary of of the written arguments. To read the full submission, please click here.

On Inadequate Consultation:

Despite many interveners’ submissions to the contrary, Enbridge states it had conducted sufficient consultation with impacted communities. The company noted they would continue to work with these communities.

Enbridge also noted that all Aboriginal consultation concerning the project was adequate and that Aboriginal rights in the area were not significantly impacted.

On Water Protection:

Several interveners, including 4 Waterkeeper groups, had expressed concern over a pipeline leak that could contaminate source drinking water. Enbridge argued they had already addressed concerns over drinking water in their written evidence and project application.

The company noted it would share ‘control point mapping’ with first responders upon request. They didn’t address requests for more valves on the sides of watercourses, or thicker pipes around water bodies. However, they did promise to provide temporary alternative drinking water to communities, should their supply be contaminated by a pipe leak.

On Spills Liability:

Despite requests from many interveners for Enbridge to have specific insurance for in case there is a Line 9 leak, Enbridge confirmed it would not take out such insurance as it is not required by the law. The company also confirmed it would not provide landowners who had the pipe running under their properties with indemnification.

Enbridge refused 3rd party examination of their assessments, and any hydrostatic testing of their pipeline.

On TTC Concerns:

Enbridge pledged it would work with the TTC and Toronto Fire Services to address the issues of the pipeline’s proximity to Finch Station.
